Terms and Conditions

By registering as a user in Lifie, you accept and agree to these Terms and Conditions (Terms). If you do not consent to these Terms, you should not register with Lifie.

1. About Lifie

Lifie is a mobile application providing health and fitness services developed by Mobifik Yazilim ve Reklam Teknolojileri Ltd. Sti. (Mobifik). Lifie is available in the iPhone App Store and can be downloaded in certain countries and regions. The main motivation and purpose of Lifie is to guide our users towards their health and fitness goals by allowing them to properly track nutrition, calorie intake, physical activity including exercises and steps, water intake and certain body measurements.

2. User Obligations

While using Lifie and services provided within, you must follow some simple rules. Lifie is only available for your private use and is not intended for commercial use. Do not misuse Lifie and services, so that either Lifie or anyone else is harmed in any way. You may only use Lifie and services as permitted by these Terms and law. By using Lifie, you agree that:

All of the personal data provided by you is accurate and up to date.

You are solely responsible for the activities and all the content uploaded or created under your Lifie account.

Lifie does not monitor the user contents, but may at any time choose, at its sole discretion, to remove user content from Lifie and/or your user account and to terminate your account and membership.

Your sign-up to Lifie, including your email and password, is personal and should not be transferred to or used by someone else. You are responsible for securing your login credentials. While taking extensive measures for the security of user data, Lifie is not in any way responsible for any loss or damage caused by unauthorized access to your account or use of your login credentials. If you suspect any unauthorized access to your account, you must immediately contact Lifie. Contact info are available at the bottom of this Terms.

Lifie is not intended for use by children under the age of 13. You must be at least 13 years old to use Lifie.

You must not engage in any unlawful activities on Lifie, including but not limited to contributing with information which in any way contains or involves incitement to racial hatred, defamation, harassment, child pornography or pornography.

You may not transmit, and/or distribute files that may damage Lifie or the users.

You may not share others’ personal information, without their approval.

You are not entitled to assign your rights and/or obligations under these Terms or use of Lifie to any third party without Lifie’s prior written consent. Lifie is entitled to assign its rights and/or obligations under these Terms.

Violation of any of these Terms will lead to a direct termination of your user account. If you violate these terms, you will not get a refund for your paid subscriptions.

3. User Account

You can at any time choose to delete/cancel your account from Settings within Lifie. Uninstalling Lifie or deleting your account will not automatically end your subscription — you must actively cancel the subscription. You can only cancel your subscription through the use of Apple services.

4. Health Information

Lifie is not a medical application and does not provide any medical recommendations, diagnoses or any sort of treatment options for you. The purpose of the services and features offered by Lifie is solely to help you to track your foods, exercises, water intake and body measurements and by this way to reach your fitness goal which is solely determined on the inputs (weight, height, age, gender) provided by you. While Lifie provides calorie recommendations and meal plans for you as detailed above, none of these should be considered as medical advice. You should consult with your dietitian or doctor before starting a diet or fitness program or if you experience any pain or discomfort. Lifie cannot guarantee any health results or improvements. Please do not use our services if you suffer from, or might suffer from, any medical condition that may be impaired by diet or exercise.

5. Intellectual Rights

All rights in and to Lifie, including any trademarks, service marks, trade names and copyrighted content (Intellectual Property) presented within Lifie are the property of Lifie and/or third parties. You agree not to use Intellectual Property for any other purposes except for your use of Lifie unless required otherwise by applicable mandatory law.

By submitting User Material to Lifie, you warrant and represent that you hold the copyright, trademark and/or other intellectual property rights to your content. You agree to grant Lifie a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use User Material to the extent necessary for Lifie to operate and maintain its services. This license shall remain valid until the respective User Material is deleted from Lifie by you or by Lifie in accordance with these Terms.

6. Lifie Premium

This term only applies when you subscribe to Lifie Premium. By paying the subscription fee, you get access to features provided by Lifie Premium during the time your subscription is valid, subject to these Terms.

All Lifie Premium subscriptions are paid in advanced.

You may at any time end your subscription, in which case your subscription will still be valid for the subscription time you have already paid for in advance. If you have subscribed to Lifie through the use of App Store using in-app purchase, you can only cancel your subscription through the use of their services. All payments handled by Apple, such as in-app purchases, can only be refunded by Apple and with Apple’s consent. Lifie reserves the right to change the subscription fees from time to time.

7. Disclaimer and Limited Liability

You use Lifie at your own risk. Lifie is provided “AS IS,” without any warranties, and Lifie does not warrant that its service and availability thereof will be uninterrupted or error-free. Lifie does not assume any responsibility for errors or omissions in the information or software or other documents, including User Material, which is referenced by or linked to. References or links to third parties’ websites are provided "AS IS", without warranty of any kind, either express or implied.

In no event shall Lifie be liable for any indirect or consequential damages, except in cases of intentional misconduct or gross negligence.

8. Changes in Terms

Lifie may update and/or modify these Terms from time to time and the most current version will always be posted on Lifie’s website (www.lifieapp.com). Any and all material changes shall become into effect between you and Lifie upon your acceptance of such changes by using the services after such notification has been made to you or renewing your subscription.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of Turkey, except for its conflicts of laws principles. All claims arising out of or relating to these Terms shall be resolved by Istanbul Public Courts.
